1. Agreement to Terms

By accessing or using Bookberry® services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Services.

These Terms apply to all visitors, users, and others who access or use the Services. By using our Services, you represent that you are at least 18 years old and have the legal capacity to enter into binding contracts.

2. Description of Services

Bookberry® provides a software-as-a-service (SaaS) platform for tour operators, activity providers, and hospitality businesses to manage bookings, products, suppliers, and reseller networks.

Our Services include, but are not limited to:

• Bookberry Engine - Booking management platform
• Bookberry Connect - Distribution network (coming soon)
• Bookberry Analytics - Business intelligence tools (coming soon)
• Bookberry Venues - Multi-location management (coming soon)

3. User Accounts

When you create an account with us, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.

You are responsible for safeguarding the password used to access the Services and for any activities or actions under your password. You agree not to disclose your password to any third party.

You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

4. Acceptable Use

You agree not to use the Services:

• In any way that violates any applicable national or international law or regulation
• To transmit any unauthorized advertising or promotional material
• To impersonate or attempt to impersonate Bookberry®, a Bookberry® employee, or any other person
• To engage in any conduct that restricts or inhibits anyone's use of the Services
• To attempt to gain unauthorized access to any portion of the Services

5. Payment Terms

Certain Services may require payment. By subscribing to a paid plan, you agree to pay all fees associated with your subscription. Fees are non-refundable except as required by law.

We may change our fees at any time by posting the changes on the website. Your continued use of the Services after the fee change becomes effective constitutes your agreement to pay the changed amount.

Monthly subscriptions can be cancelled at any time. Annual subscriptions are non-refundable for partial periods.

6. Intellectual Property

The Services and its original content, features, and functionality are and will remain the exclusive property of Cityberry Travel Technologies and its licensors. The Services are protected by copyright, trademark, and other laws.

Our trademarks may not be used in connection with any product or service without our prior written consent.

7. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including without limitation if you breach the Terms.

Upon termination, your right to use the Services will immediately cease. If you wish to terminate your account, you may simply discontinue using the Services or contact us to delete your account.

8. Limitation of Liability

In no event shall Cityberry Travel Technologies, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

Our liability is limited to the maximum extent permitted by law.

9. Disclaimer

Your use of the Services is at your sole risk. The Services are provided on an "AS IS" and "AS AVAILABLE" basis. The Services are provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of Turkey, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

11. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
